Whereas you are financial planner or an advisor who claim to have requisite knowledge of financial planning to service and help users of www.arthasarathi.com to carry out their comprehensive financial planning and  have agreed to register your profile with www.arthasarathi.com as a registered financial planner with view to reach out to the potential users who may be interested in availing your services at a fee,

Whereas you understand that  www.arthasarathi.com is an on-line Directory of Financial Planners / Advisors and Robo Advisors like you wherein they get themselves registered and may also pay an annual subscription fee based on the level of service that we offer to them.

 www.arthasarathi.com (Hereafter referred as “AS”) offers a charged and, in some cases free registration to showcase their professional capabilities in the domain of personal financial planning but does not a solicit any professional work by any of the Advisor whose Profile is displayed on the website.

For the purpose of this agreement, the following definitions are applicable

Definitions

• “Financial Planners and Advisors” Hereafter referred as “FPA”s: The term “Financial Planner and Advisors” means and includes persons/professionals (whether individuals, firms, companies or LLPs) competent and qualified to impart “services” depending upon the requirements of the regulator(s) of these “services”.
• “Service” : Service for this Offer means all services as enumerated under the icon – “Services to be covered under personal finance domain” and elaborated in details as below,
• “Users” User for this Offer means all persons (including individuals, FPAs, companies, LLPs, partnership firms or other entities) who get themselves registered with www.ArthaSarathi.com with intent to view, review and utilize the services of the FPAs registered on AS, for individuals or group of individuals (Who are not Financial Planners or Advisors) who willingly wish to explore, know more and avail financial planning services for themselves
• A financial plan means a written or non-written statement of advice by FPA to user for investing in the financial markets ( India or worldwide) for meeting users financial goals or obligations as mutually discussed between user and FPA ( facilitated by AS) in online and /or offline mode and after explicit agreement on such data sharing between the user and FPA
• Review of the financial plan – A pre-agreed (mutual consent) review of the advice between the FPA and users to check if the objectives and actions agreed in the financial plan are being met or any course correction is needed during the agreed time period
• A Sample Financial Plan means  A brief written financial plan submitted by FPAs based on limited information about user ( submitted voluntarily by the user on their AS profile at the time of accessing site) whereas FPA has explicitly agreed to offer such a plan at the time of registration of their profile with AS
• A comprehensive financial plan means a detailed written financial plan submitted by FPA based on information submitted by the user after having a detailed one to one discussion with the user in ONLINE or OFFLINE mode ( based on mutual convenience between FPA and user submitted to AS) facilitated by AS.
• Robo advisors : A robo advisor is an online or app that offers investments, financial planning, saving or expenses management or any such services related to personal financial planning, investments or goal based financial planning for the user. Such services are offered through web-site or a mobile app which is backed by team of experts and software programs that direct the investment advice, such advisors voluntarily listed their profiles on AS with an objective of reaching out to AS users 
• AS Ratings : this is a rating offered by AS to their users on the services offered by FPAs and Robo Advisors based on the information provided by FPAs and Robo Advisors to AS and user reviews received on AS from registered users who claim to have availed such services from FPAs / Robo advisors via AS or otherwise

Services

AS offers free or paid registration for services mentioned below

• Provide basic understanding and knowledge about various investment instruments, the process of personal financial planning and related fields through articles, videos , case-studies ( list is not exhaustive and may be modified with additional items from time to time) from FPAs, robo advisors and / or www.arthasarathi.com
• View detailed profiles, credentials, schedule of services offered by FPAs and /or robo advisors along with information of fees chargeable by the FPAs / robo advisors to carry out personal financial planning of the users or such services as listed by FPAs / users on their AS profile and to users who requested them such services
• View reviews, opinion expressed by other users who have availed services from FPAs and robo advisors  through www.arthasarathi.com or otherwise
• Request for a sample financial plan or free downloads from such FPAs or robo advisors  who explicitly agreed to offer such a sample financial plan or free download at the time of their registration with www.arthasarathi.com
• Chat online ( if FPA is logged on to ArthaSarathi) or leave an e-mail message to FPAs seeking enquiries or details listed by FPAs under their profile

AS  would seek subscription fees ( monthly, quarterly , yearly or multi year terms as mutually agreed from FPAs to 

• Create their profile on AS and be made available to users
• To be rated as BRONZE, , SILVER, GOLD , TITANIUM or PLATINUM advisors based on information furbished by the FPAs and their contributions / activities on www.arthasarathi.com for making users aware about their expertise and knowledge on financial market with a view to offer such services listed on AS
• To publish the review ratings from registered users on AS website for such services which were availed by users from the Advisors through or not through AS While AS will verify the veracity of such claims made by the users and use discretion in publishing such reviews, AS doesn’t guarantee that such reviews are completely true,
• Propogate , carry out marketing activities for FPA’s profile to a potential set of users with a view to increase FPAs business
• Carry out targeted marketing campaign on behalf of FPA to a set of potential users for increasing their business

AS remains indemnified as

• Any reviews , comments or interactions done by the users with FPAs are not AS opinion on the FPA and AS is merely acting as a facilitating technology platform with a view to create awareness about FPAs services to the public in general ( online mode) and users in particular
• Rating and customer reviews are merely an outcome based information provided by the FPA and their contributions based on AS ‘s proprietory rating engine and do not constitute as an opinion from AS to such services or their quality
• AS will be liable only to the extent of fees payable from user to FPAs in respect to any transactional loss , damage, breach caused to the FPA from user opinions or bad ratings
• Any actions / disputes arising out of offering a sample financial plan or a comprehensive financial plan by FPA are a matter between user and FPA – AS will act in the best capacity to be a facililator in resolving such issues but will not be liable to pay for any damages or  

Acceptance of Terms & Conditions

This Web- Site is offered to the user of the Service (User) on the condition that the User accepts the terms contained herein, without any modification whatsoever. For the purposes of this Terms of Use, ‘Service’ shall mean and include, without limitation, as mentioned above whether provided by AS or by FPAs or robo advisors registered thereon whether pursuant to subscription, if any, or otherwise. By agreeing to this terms of use , the user agrees to the following statement “Notwithstanding my telephone/mobile is registration with NDNC and or notwithstanding the Telecom Regulatory Authority of India [TRAI] restrictions/guidelines on unsolicited telecalls, by my accessing and registering with my details on this web site and leaving the site half way enquiring about services and products offered by www.arthasarathi.com’ products/services and or my making a request to call me back, it is deemed that I have expressly authorized www.arthasarathi.com and / or I am hereby authorizing www.arthasarathi.com to call me back or send me text messages for solicitation and procurement of various products and services of www.arthasarathi.com In this regard I shall not have any complaint nor complain to TRAI as to any alleged unsolicited calls by www.arthasarathi.com to me.

AS hereby grants to the User, the right to use the Service in accordance with these terms, and for no other purpose.
